Terms and Conditions

Please read these terms carefully before using our services. Access to and use of the platform implies acceptance.

1. Identification

The sites plancton.ai, app.plancton.ai and api.plancton.ai (hereinafter, "Plancton" or "the Platform") are operated by the entity Plancton.ai. Plancton is the provider and owner of the services available on its domains.

2. Acceptance of Terms

Access to and use of the Platform implies that the user has read, understood and agrees to be bound by these Terms and Conditions, our Privacy Policy and any complementary policies (e.g. Cookies Policy). If the user does not accept these conditions, they must refrain from using the services.

Plancton reserves the right to modify these Terms at any time. The updated version will be published with the corresponding effective date; continued use of the platform implies acceptance of the modifications.

3. Users and Accounts

3.1 Age and capacity requirements. To use Plancton, the user must be at least 18 years old or the minimum age required in their country to consent to digital services. Plancton does not accept users under 13 years of age.

3.2 Registration and truthfulness. Certain features require creating an account. The user must provide accurate, up-to-date and truthful information. Plancton reserves the right to suspend accounts with false data. The user is responsible for keeping their credentials confidential.

3.3 Corporate domains. If the user creates an account with a corporate email, Plancton may associate that account with an enterprise account of the domain holder.

4. Plancton Services

Plancton offers AI services such as generative chatbots, data analysis, dashboards and an API. The user is granted a limited, revocable, non-exclusive license to use these services.

Prohibited actions:

  • Using services for illegal, abusive or fraudulent purposes.
  • Infringing third-party rights or violating data protection laws.
  • Reselling, sublicensing or renting Plancton software or models.
  • Reverse engineering or attempting to derive source code.
  • Automated access, scraping or data extraction.

5. Fees and Billing

Registration may be free, but certain features operate under subscription or consumption fees. Prices are subject to change.

All transactions are subject to verification. The user authorizes Plancton to charge the selected payment method. In automatic renewal plans, the user may cancel before the renewal date.

6. User Generated Content & AI

The user may input data ("Input") and receive AI-generated results ("Output"). The user retains rights to the Input and Plancton assigns rights to the Output where permitted by law.

6.2 Data usage: Plancton may use content to provide and improve services. Users may request exclusion from model training by contacting support.

6.3 Output accuracy: AI may generate incorrect content. The user accepts that they must evaluate the accuracy of the Output and use it at their own risk. It should not be used for significant decisions (legal, medical, etc.).

7. Intellectual Property

All intellectual property rights regarding the Platform, software, design, databases, AI models, brands and logos belong to Plancton or its licensors. Unauthorized reproduction or use is prohibited.

8. Security and Availability

Plancton makes reasonable efforts to ensure security and availability but does not guarantee the absence of errors or interruptions. The service is provided "as is" and "as available". The user is responsible for their data backups.

9. Third-Party Services

Plancton integrates third-party services, including:

  • AWS, Cloudflare (infrastructure & security)
  • Stripe (payments)
  • OpenAI, Gemini (AI processing)
  • Google (OAuth, Gmail API)
  • WhatsApp, Meta Graph API (messaging)

Each service is subject to its own terms. Plancton is not responsible for third-party actions.

10. Termination

Plancton may suspend or cancel accounts for violations of these Terms. Users may cancel their account at any time. Cancellation does not affect prior obligations.

11. Modifications

Plancton may modify these Terms at any time. New conditions apply upon publication. Significant changes will be notified. Continued use implies acceptance.

12. Applicable Law

These Terms are governed by the laws of Mexico. Any controversy shall be submitted to the courts of Mexico, without prejudice to applicable consumer protection laws.
